In Chapters XI and XII of the Public Procurement Act, provisions are set out regarding the Public Procurement Complaints Committee and available complaint procedures. Among other things, Article 106(1) provides as follows: A complaint shall be submitted in writing to the Public Procurement Complaints Committee within 20 days from the date on which the complainant knew, or ought to have known, of the decision, act or omission which the complainant considers to infringe its rights. A claim for a contract to be declared ineffective may, however, be submitted to the Committee within 30 days from the aforementioned point in time. Such a claim for ineffectiveness may not be brought once six months have elapsed from the conclusion of the contract. The following applies when determining the time limit more specifically: Where the complaint concerns a decision on the selection of a tender or other decisions under Article 85(1) and (2), the time limit shall run from the publication of the notices referred to therein, provided that they contain the required information. Where a claim is made for the ineffectiveness of a contract that has been concluded without prior publication of a contract notice, the time limit shall run from the subsequent publication of the contract award notice in the Official Journal of the European Union, provided that the notice includes the contracting authority’s reasons for deciding not to publish the procurement. A complaint shall include information on the complainant, the party against whom the complaint is directed (the respondent), and the decision, act or omission being challenged. The complaint shall state the complainant’s claims, together with a brief description of the facts of the case, the grounds for the complaint and the supporting reasoning. The complainant’s claims shall relate to the remedies available to the Committee under the Act. The complainant shall notify the contracting authority of the complaint as soon as possible. A complaint fee of ISK 210,000 shall be paid for each complaint. Tenderers are encouraged to familiarise themselves further with the remedies available under Act No. 120/2016 on Public Procurement.
