Public transport in the capital area of Iceland

On behalf of Strætó bs., Reykjavik procurement department will call for interested parties to participate in the procurement process for the service ‘Public transport in the capital area of Iceland’. This procurement contains around 170 thousand timetable times a year with 48 operational buses from the beginning of winter driving in August 2016 to the end of summer driving in August 2020. Interested parties must submit an application and offers, which must be in accordance with section 0.1.5 ‘Samningskaupagögn’.
The procurement procedure of this negotiated procurement is in accordance to the rules of the Directive no. 2004/17/EC of 31.3.2004. Reference is made to the CPV number 60112000.
This tendering procedure is conducted electronically in accordance with the guidelines on electronic submission on tenders in Directive no. 2004/18/EC.
It is requested that participants will be able to meet the requirements of the Icelandic act no. 73/2001 on public — and cargo transport along Icelandic regulation no. 528/2002 about public transport on land. It is required that the participants has at least 3 years of continuous experience of similar services in question and/or that the owner, manager or key employee has at least 6 years of continuous experience of similar services in question.
This procurement is divided into 9 different procurement parts. After completion of the procurement process, it is expected to conclude service contracts with 2, 3 or 4 candidates who meet the qualification requirements as well as to get the highest score/s for the final proposal and quote. The combination of procurement parts that gives the highest average score will determine the choice of contracting parties. The combined maximum size of contracts concluded with individual operators after completion of this procurement process will be limited to 75 % of the estimated total number of operational buses of this procurement. Furthermore, the combined minimum contracts concluded with individual operators will be limited to 25 % of the total number of operational buses. Applicants should refer to these restrictions when combining different procurement parts in its bid. It is possible that the above restrictions will be changed on the negotiated stage.
It is allowed to extend contracts up to 4 years. Extension of the contract can take place up to 2 times for 2 years each time. If the operator meets the minimum quality of the first 3 years, then the operator has unlimited right of contract extension for 2 years with unchanged terms, or until August 2022. Extension of contract to August 2024 is subject to reservation, see section 0.6.2 ‘Samningstími’.

In accordance to Icelandic act on public procurement, the economic operator can bring a complaint to the Complaint committee of public procurement. The complaint must be submitted to the committee in writing within 20 days from the time that the economic operator knew or should have known of the decision, act or omission, he believes violate his rights, cf. act on public procurement, section 94, paragraph 1. After a binding contract is reached, the Complaint committee of public procurement has no authority to stop the negotiations. For each complaint the economic operator shall pay a complaint fee of 150 000 ISK, according to the act on public procurement, section 94, paragraph 5.
